Witnesses presented graphic evidence Wednesday in the trial of Cristobal Stephan Garzez, accused of killing tow truck driver David Zapata in a July 8, 2025, crash in Harlingen, Texas.

Zapata, 46, was securing a vehicle to his tow truck on the expressway shoulder when Garzez allegedly struck the truck and fled, according to authorities.

Texas Department of Public Safety investigators testified that Zapata’s body was found in two sections of the roadway. Investigators said the tow truck was stationary on the shoulder with its emergency lights activated. The first responding trooper testified that visibility was clear but he did not recall seeing flashing lights.

Crash investigator Paulina Castillo described evidence collected at the scene, including blood, personal belongings and skid marks.

Lead investigator Trooper Jesus Molina testified that Garzez displayed six signs of intoxication during an eye-movement sobriety test. Witness Sergio Ortega also identified Garzez in a photo lineup.

The defense questioned witnesses about the investigation and evidence collection.

Garzez has pleaded not guilty to intoxication manslaughter, manslaughter and possession of a controlled substance. Testimony was expected to continue Thursday.
