Kentucky Towing Company Sues Over Proposed Fee Limits

Fountain Square Towing of Bowling Green has filed a lawsuit against the city over a proposed ordinance that would tighten regulations on towing companies. The measure would lower the maximum towing fee from $175 to $125 and as little as $75 if the vehicle owner arrives during the tow. It would also eliminate after-hours charges and reduce boot removal fees.

Attorney Alan Simpson, representing the company, argues the ordinance unfairly restricts business practices and conflicts with state and federal law. “I gave you an off-ramp with this letter,” Simpson told city commissioners on February 17. “We will challenge any ordinances you pass.”

Fountain Square Towing patrols private parking lots, including student housing complexes, providing free enforcement services to property owners while vehicle owners pay towing fees.

The lawsuit challenges the city’s existing 2014 ordinance and cites Kentucky statutes and federal law. Supporters of the proposal say lower fees would protect students and residents from excessive charges.
